Motivation & Productivity Program Subscription Contract

1. Enrollment Date and Initial Payment

• Billing for your subscription begins on the date you enroll (the “Enrollment Date”). Your first payment will be processed on this date.                                            

2. Subscription Terms

• Your subscription renews automatically each month on the same date as your Enrollment Date. For example, if you enroll on the 15th of a month, subsequent payments will be charged on the 15th of each following month.
• Subscription payments are non-refundable, and cancellations will not be pro-rated.

3. Payment Method

• Payments are processed automatically via Stripe using the payment method provided during enrollment.
• It is the Client’s responsibility to ensure that the payment method remains current and valid.
• If you do not have a valid payment method on file, your subscription will not renew and you will lose access to your MAP program subscription at the end of your current billing period.

4. Cancelling Your Subscription

• To avoid being charged for the next billing cycle, you may cancel your subscription at any time through one of the following methods:                                        

Method 1: Self-Cancellation

1. Log into your LearnWorlds account and navigate to the Account page.
2. Locate and click the Cancel Subscription button.
3. Confirm your cancellation when prompted. Once confirmed, your subscription will be scheduled for cancellation at the end of the current billing cycle, and you will maintain access to all subscription benefits until that date.
4. After cancellation, a reactivation option for the same subscription plan will be available on the Your Account page until your renewal date passes. If you wish to re-enroll after this period, you will need to purchase a new subscription.

Method 2: Email Cancellation Request

1. Send an email to MAP@worksmartcoaching.com at least seven (7) days before your next billing date to request cancellation. Our team will process your cancellation, and you will retain access to your subscription benefits until the end of the current billing cycle.
   

• At Beyond BookSmart/WorkSmart Coaching, we hire highly qualified individuals regardless of beliefs, identity, or age. We match coaches based on client needs for skill development and do not specify personal information about our coaches to ensure fairness and equity. You can trust our team is well-trained and dedicated to supporting you.

• We guarantee that we are providing you with highly qualified coaches, a willingness to listen and respect you, and a total commitment to your success. Beyond that, and except as explicitly started above or in other documents which we have committed, we cannot provide a warranty of any kind, either expressed or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. Each client is unique, and your own commitment to the process largely determines your outcome. 
• The entire liability of the company and your sole exclusive remedy in the event the services do not meet any of the covenants or standards agreed to is limited to the fee paid to Beyond BookSmart. 
• In no event shall Beyond BookSmart be liable for any indirect, special, incidental, or consequential damages arising out of or relating to the services being provided hereunder, even in the event the company has been or is thereafter, advised of the possibility of such damage. 
• This agreement constitutes the entire agreement related to the subject matter hereof and supersedes all prior communications, representations, or agreements, oral or written and this Agreement may not be modified, amended, discharged, terminated, or supplemented, or otherwise changes, except by a written document signed by you and Beyond BookSmart/WorkSmart Coaching. 
• This agreement is not for the benefit of any third party and shall not be deemed to give any right to remedy to such third party. The rights and obligations under this agreement may not be assigned without the express written approval of Beyond BookSmart. 
• Regardless of the place of execution hereof, this Agreement, all amendments hereto, and any and all issues or controversies arising here from or related hereto, shall be governed and construed exclusively in accordance with the laws of the Commonwealth of Massachusetts. The Suffolk County Superior Court of Massachusetts or any other form in Massachusetts shall have personal jurisdiction over the parties and such courts shall be the exclusive venue with respect to any claims or disputes related to this Agreement. The parties to this Agreement expressly waive their right to trial by jury in the event of any dispute arising out of or related to this agreement.
